You or your spouse must be either (1) a domiciliary of New Jersey or (2) be a military service member stationed in New Jersey. In either scenario you or your spouse must be domiciled or stationed in New Jersey for at least six months and be a resident of the county for at least 90 days at the time of filing the Petition for Divorce with the county district court. You are domiciled in New Jersey if you live in New Jersey with the intention of making New Jersey your permanent home. For example, where do you primarily live? Sleep at night? Get your mail? What address is on your driver's license? What address is on your federal tax return? If New Jersey, then you are domiciled in New Jersey. Military service members do not have to be domiciled in New Jersey but simply stationed in New Jersey. If you or your spouse is a New Jersey resident and either of you is in the military or on government service you are considered a domiciliary of New Jersey if New Jersey is your home state.
